General Conditions of Use (GCU)

The purpose of this document is to define the terms and conditions under which the APROFED Association makes the site and the services available on it available to its users on the one hand and, on the other hand, the manner in which the user accesses the site and uses said services.
Any connection to the site is subject to compliance with these conditions.
For the user, simply accessing the association's website at the following URL address www.aprofed.nc implies acceptance of all the conditions described below.
In the event that the User does not wish to accept all or part of these T&Cs, he/she is asked to refrain from using the service.
The association reserves the right to modify, without notice or compensation, or to update these T&Cs at any time and without prior agreement from Users. Users are therefore advised to regularly refer to the latest version of the T&Cs, which is permanently available on the Site.
The association cannot be held responsible in the event of use of the Site by a User that does not comply with these T&Cs.

- Site Access and Availability
The association strives to allow the user access to the site 24 hours a day, 7 days a week, except in cases of force majeure or an event beyond the control of the association.
Thus, the association cannot be held liable if consultation of the site or downloading from it is delayed or prevented due to a case of force majeure or fortuitous event, due to the other party or a third party or external causes such as social conflicts, intervention by civil or military authorities, natural disasters, fires, water damage, interruption of the telecommunications network or the electricity network.
The Internet user cannot claim any compensation in this case.
The association will make its best efforts to make the Site permanently accessible except for maintenance or update operations scheduled by the association, without the association being liable for any consequences linked to these interruptions.
The Site's features will be regularly updated to improve the quality of service and the User experience.
Depending on where you connect to the Site from, including a secure network (for example, in a large company), you may not have access to all or part of the service, beyond our control.
The association gives no guarantee, without this list being exhaustive, as to the quality and compatibility of the Site for a specific use or environment.

- User Responsibility
Any published contribution remains the responsibility of its author. As such, users wishing to leave a testimonial or contacting the association via the email address provided on the contact page are asked to observe rules of good conduct, a non-exhaustive list of which is provided here.
User contributions must not, in particular:

Furthermore, the user undertakes not to counterfeit texts published by the association and to cite their sources for each publication containing a quote from the association.
The association specifies that user data may be communicated to any judicial authorities that request it, as well as to any third-party technical service providers of the association, it being understood that the third-party technical service provider does not have the right to use the data provided for purposes other than the technical mission for which it is entrusted.

Browsing the website www.aprofed.nc does not require us to collect or process any personal data. The only data we can access about you is the data you provide when you contact the association via its email address.
The data collected is intended for use by the association. It is necessary for the relationship between the User and the association.

- Applicable law
These T&Cs are subject to French law.
Only the courts of Noumea will have jurisdiction in the event of a dispute relating to the interpretation or validity of these T&Cs, failing a prior amicable solution between the APROFED association and the User.
